If You’re Planning to Build a Pool or Spa

In Victoria, the design, construction, and installation of swimming pools, spas, and safety barriers are subject to strict regulations.

Key requirements include:

  • Pools and spas must be constructed by registered builders or owner-builders with the appropriate certificates.
  • Self-latching and self-closing gates must be in place for pool barriers.
  • Pools and spas must comply with the standards outlined in AS1926.1-2012.

As a property owner, you’re responsible for ensuring your pool barrier is properly maintained, repaired, and in working order. Additionally, outdoor pools must not be directly accessible from a building.

New Pool & Spa Registration and Inspection Requirements

As of 1 December 2019, new laws were introduced in Victoria to improve pool and spa safety. These laws include registration, inspection, and certification requirements for pool owners.

As a pool or spa owner, you must:

  1. Register your pool or spa with your local council.
  2. Once registered, schedule a pool safety inspection with a registered pool inspector. That’s where Keep Safe Inspections can assist — we offer pre-inspections and compliance inspections.

If any non-compliance issues are found, they will need to be rectified before re-inspection. We can help guide you through the process, and once everything is fixed, we’ll issue you with a certificate of compliance to submit to your local council.

Maintaining Your Existing Pool or Spa

As a pool or spa owner, you are required to maintain the safety of your pool barrier to prevent unauthorized access and ensure safety.

To help you assess the safety of your barrier, we’ve provided checklists based on the relevant standards for when your pool or spa was installed:

  • Pools Installed Before 8 April 1991
  • Pools Installed Between 8 April 1991 & April 2010
  • Pools Installed After 1 May 2010

If you’re making any changes to an existing safety barrier, a permit may be required, and the work must comply with the current regulations.
